비숙련공 이민 비자 소진 및 퇴행 발표

Q1:
지난 2003년도 1월에 비숙련공으로 신청하여 2년이 지난 이번달에 L/C (노동부 허가서)가 나왔습니다.  기쁜마음으로 영주권 신청과 이주허가 신청을 이민국에 하려고 하는데, 이번달부터 비숙련공 문호가 닺혀있어서 더 이상 영주권신청을 못한다는 난감한 처지에 있습니다.  도대체 지난달에도 아무 이상없이 신청되었던 영주권 신청이 왜 안되는지 자세한 설명을 듣고 싶습니다.

귀하의 사례를 이해하려면, 흔히 말하는  “영주권 문호”의 의미를 확실히 알아야만 되겠습니다.  “영주권 문호가 닺혀서 영주권 신청을 못한다”는것은 아래의 이민신청 전반 절차안에서 한과정에 걸림돌이 있다는 의미입니다.  영주권 신청은:
1) 고용주가 주 노동청에 신청서와 제반 서류를 제출하여 일차허가를 받고;
2) 일차 허가된 서류가 연방 노동청 (DOL)으로 가서 추인이 되고;
3) 마지막으로 연방 CO (Certifying Officer)가 L/C를 발행하게 됩니다.
이렇게 L/C가 나온상태에선 최종단계로써, 고용주는 이주허가서(I-140)를 이민국에 신청하고, 동시에 외국 고용인은 이민국에 “영주권 신청서” (I-485)를 신청함으로써 영주권이 나오게 됩니다.  
귀하의 케이스로 돌아가서, 이번에 발효된 비숙련공 “영주권 문호”가 막혔다는 의미는 영원히 영주권 신청을 못한다는 의미가 아니라, 기다렸다가 문호가 열리는 시점에 I-485 신청서를 제출할수 있다는 의미입니다.  3월에 발표된 해당 순위 (비 숙련공 취업 3 순위)를 보면 2001년 7월 1일이 풀리고 있다고 합니다.  귀하의 경우는 2003년 1월의 우선 순위(PRIORITY DATE)를 가지고 있기에, 대략 1년반을 기다린 후에야 영주권 신청이 가능하다는 의미입니다.  다시 설명드리면, 1년반 후인 2007년 9월이 되야 귀하가 가지고 있는 우선순위일(2003년 1월)이 풀린다는 의미입니다.

Q2:
위 질문과 연관이 되는데, 그렇다면 고용주 또한 기다렸다 이주허가 신청을 하여야만 하는지요?
A2:
영주권 문호는 피고용인에만 해당되는 사항이지, 고용주는 여전히 이주허가 신청서(I-140)를 이민국에 제출하여 미리 승인서를 받을수 있습니다.  물론 고용주에게도 똑 같은 불이익이겠지만, 미리 승인서를 받은들 외국인을 고용하기 위해선 영주권 문호가 열릴때까지 기다려야 합니다.  이주허가 승인서가 무용지물인셈이기에, 신청자체를 유보하는 고용주가 대부분입니다.

Q3:
숙련공으로 신청을 한 신청인입니다.  이번 영주권 문호의 퇴행(Retrogression)이 숙련공과도 연관이 있는지요?
A3:
다행히 외국- 피고용인의 국적이 중국/인도/필리핀이 아닌경우에는 현재도 영주권 문호가 열려있습니다.  따라서, 일단 L/C가 나온경우에는 영주권신청과 고용주의 이주허가 신청을 동시에 추진할수 있습니다.

Q4:
취업/숙련공 영주권 신청인입니다.  이미 L/C가 취득된후 영주권 신청을 한 상태입니다.  이곳에 비이민 비자(B/H/E/L비자등등)로 입국한후, 영주권 신청이 들어간 시점부터 비자합법지위(VISA STATUS)를 지키지 못하고 있는데, 이런경우 어떠한 영주권 취득에 결격사유가 될수 있는지요?
A4:
일단 영주권 신청이 될 당시에 합법지위를 가지고 신청되었다면 더이상 문제시 되지 는 않습니다.  단 한가지 꼭 유념하여야할 사항은, 만일 영주권 신청후 이주허가 승인이 거부되거나, 혹은 또다른 제2의 고용주를 통하여 재신청이 들어갈 경우에는 단순히 이전에 신청하여 기다린 지위(Pending Status)를 합법지위(Legal Visa Status)로 간주하지 않음을 반드시 주의하여만 합니다.

IMMIGRANT NUMBERS FOR FEBRUARY 2005
A. STATUTORY NUMBERS
1. This bulletin summarizes the availability of immigrant numbers during February . Consular officers are required to report to the Department of State documentarily qualified applicants for numerically limited visas; the Bureau of Citizenship and Immigration Services in the Department of Homeland Security reports applicants for adjustment of status. Allocations were made, to the extent possible under the numerical limitations, for the demand received by January 10th in the chronological order of the reported priority dates. If the demand could not be satisfied within the statutory or regulatory limits, the category or foreign state in which demand was excessive was deemed oversubscribed. The cut-off date for an oversubscribed category is the priority date of the first applicant who could not be reached within the numerical limits. Only applicants who have a priority date earlier than the cut-off date may be allotted a number. Immediately that it becomes necessary during the monthly allocation process to retrogress a cut-off date, supplemental requests for numbers will be honored only if the priority date falls within the new cut-off date.
2. Section 201 of the Immigration and Nationality Act (INA) sets an annual minimum family-sponsored preference limit of 226,000. The worldwide level for annual employment-based preference immigrants is at least 140,000. Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits, i.e., 25,620. The dependent area limit is set at 2%, or 7,320
3. Section 203 of the INA prescribes preference classes for allotment of immigrant visas as follows:
FAMILY-SPONSORED PREFERENCES
First : Unmarried Sons and Daughters of Citizens: 23,400 plus any numbers not required for fourth preference.
Second : Spouses and Children, and Unmarried Sons and Daughters of Permanent
Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers:
A. Spouses and Children: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;
B. Unmarried Sons and Daughters (21 years of age or older): 23% of the overall second preference limitation.
Third : Married Sons and Daughters of Citizens: 23,400, plus any numbers not required by first and second preferences.
Fourth : Brothers and Sisters of Adult Citizens: 65,000, plus any numbers not required by first three preferences.
EMPLOYMENT-BASED PREFERENCES
First : Priority Workers: 28.6% of the worldwide employment-based preference level, plus any numbers not required for fourth and fifth preferences.
Second : Members of the Professions Holding Advanced Degrees or Persons of Exceptional Ability: 28.6% of the worldwide employment-based preference level, plus any numbers not required by first preference.
Third : Skilled Workers, Professionals, and Other Workers: 28.6% of the worldwide level, plus any numbers not required by first and second preferences, not more than 10,000 of which to "Other Workers".
Fourth : Certain Special Immigrants: 7.1% of the worldwide level.
Fifth : Employment Creation: 7.1% of the worldwide level, not less than 3,000 of which reserved for investors in a targeted rural or high-unemployment area, and 3,000 set aside for investors in regional centers by Sec. 610 of P.L. 102-395.
4. INA Section 203(e) provides that family-sponsored and employment-based preference visas be issued to eligible immigrants in the order in which a petition in behalf of each has been filed. Section 203(d) provides that spouses and children of preference immigrants are entitled to the same status, and the same order of consideration, if accompanying or following to join the principal. The visa prorating provisions of Section 202(e) apply to allocations for a foreign state or dependent area when visa demand exceeds the per-country limit. These provisions apply at present to the following oversubscribed chargeability areas: CHINA-mainland born, INDIA, MEXICO, and PHILIPPINES.
5. On the chart below, the listing of a date for any class indicates that the class is oversubscribed (see paragraph 1); "C" means current, i.e., numbers are available for all qualified applicants; and "U" means unavailable, i.e., no numbers are available. (NOTE: Numbers are available only for applicants whose priority date is earlier than the cut-off date listed below.)
